Rival Market
Leicester City Council licence both car boot sales and flea markets via their Rival Markets Policy.

GENERAL CONSIDERATIONS:
The City Council currently operates Retail Markets in the Market Place, Leicester City Centre and at Beaumont Leys Shopping Centre, Beaumont Leys, Leicester. Any Market which is operated, other than by the City Council, within a radius of 6 and 2/3 miles of any Retail Market operated by the City Council, shall be deemed a Rival Market.

A market shall be deemed a Rival Market, irrespective of the type of goods or general nature of the market. The legal definition of a market, being a 'concourse of buyers and sellers', shall apply in determining whether an event constitutes as a Rival Market or not. In this respect, such events such as Car Boot Sales, Antique Fairs, etc., shall be deemed Rival Markets. Furthermore there should be 5 or more sellers present in order for the event to be deemed a Market. There is no minimum number of buyers.

LICENSING POLICY:  It is unlawful to operate a market without a Licence
The City Council have approved a policy, outlining conditions under which licences will be issued to Operators, allowing Rival Markets to be held. Any such person who wishes to operate a Rival Market, may only do so, if such a market has been licenced by the City Council. A licence will normally be issued, provided the application complies with the following conditions:-
 
  • Rival Markets will be limited to a maximum of 50 trading positions (ie stalls/vehicles/pitches). Each trading position shall be of a standard size, with a maximum size of 8 x 6 feet.
 
  • Car Boot Sales, shall be restricted as far as possible, to householders selling surplus household articles. No new goods are permitted for sale at any Rival Market, other than speciality events.
