Smokefree Workplaces and Public Places

Smokefree Workplaces

 

Following the implementation of the Health Act 2006 and associated Smokefree Regulations on 1st of July 2007 virtually all enclosed public places and workplaces in England must now be smokefree by law. Vehicles used for work and by more than one person must also be smokefree regardless of whether the vehicle is privately owned, e.g. a taxi. A smokefree England will ensure a healthier environment, so everyone can socialise, relax, travel, shop and work free from secondhand smoke.

 

Whether you are a business owner, an employee or a member of the public you may have questions about what constitutes a smokefree premises and what you need to do to comply with the law. If you are a business owner you may be considering providing a smoking shelter for your staff and customers to use. For information and guidance on how to make sure that your shelter complies with the law please see Smoking Shelters.  All businesses intending to construct a smoking shelter are asked to complete a Pre Planning Application which is used to feedback to the applicant whether their proposal is likely to comply, not just with the smokefree regulations, but also other associated legislation.

 

Shisha Cafes are not exempt from the Smokefree Regulations and must comply like all other workplaces. If you would like further information or advice on this issue please contact the Health and Safety Team.

 

Businesses may find that implementing a Smokefree Policy helps them to explain to employees how the the requirements of the Smokefree Regulations will affect them at work.
