Data Protection

Under the Data Protection Act 1998 (DPA), you have the right to apply for a copy of personal data held by the Council (the “data controller”) about you.

You can appoint someone to apply on your behalf e.g. your legal guardian or a solicitor.

If you want to request a copy of the information the Council holds about you, you should provide:

A request in writing;
Sufficient information for us to locate it.

Although entitled to charge a fee, Leicester City Council currently provides Subject Access free of charge.

Points to remember

The Council is not obliged to comply with a Subject Access request on the basis of "What does the Council hold on computer about me?" It is also not obliged to comply with verbal requests for information.

The Council will ask you questions to identify what information you require and what your working and business connections are with it to help locate where the data may be held.

Information that may be exempt from disclosure to the data subject could include:

Personal data where disclosure could prejudice the prevention or detection of crime;
Management forecasts/management planning;
Legal professional privilege (advice we receive from our solicitors, for example);
Personal data identifying another person (a third party) whose details should not be disclosed without their permission.

You are entitled to be told whether the Council, or someone acting on its behalf, is processing (using) your personal data and if so be given a description of:

The personal data
The purpose (s) for which it is being processed
To whom the data are or may be disclosed
The source of the information (exemptions may apply)
The logic behind processing (except in the case of trade secrets)

If no data is held, or the data falls into a category exempted from disclosure, you should be notified in writing of this.

In all cases the Council is then required to respond within a statutory maximum limit of 40 calendar days of receiving your full request, either with the information required, or with an explanation of any delays.
 
Information about other people
 
Please note also that Leicester City Council will not discuss other people's (third party) details, such as their accounts or applications with you without the expressed written and signed authorisation of that person when they are not present.
 
To discuss someone else' details with you, we will need this or a valid legal document to be presented (e.g. Power of Attorney). 
 
We do this for the protection of all our customer's personal information as governed by the Data Protection Act 1988.

How to request a copy of your personal information

Responsibility for responding to requests for personal data lies with individual departments within the Council. If you know which department holds your personal information, please write to them directly.

Alternatively, you can download and complete the form attached below to request a copy of your personal information held by the Council and either post it to the relevant department, or email either it or your own request to one of the following departmental addresses:
