Environmental Information Regulations

The Environmental Information Regulations 2004 (EIR) provide you with a right of access to a wide range of environmental information held by the Council. They came into full effect from January 2005.

"Environmental information" is:

Any information relating to the state of land, including water, air, flora or fauna;

Any information about activities which adversely affect the environment (including noise and other nuisances); and

Any information about measures which are designed to protect the environment.

This also includes plans, programmes, cost-benefit and other economic analyses which relate to environmental information.

Other information held by the Council such as information relating to road, traffic, maintenance, land use planning, development control, buildings and estates is also considered to be environmental information.

Facts about EIR:

You can request the information over the telephone and do not need to put it in writing;

You will be able to say in what format you wish to receive the information;

The timescale for responses is one month (in practice 20 working days);

The Council can make charges within reason for supplying information under EIR;

The Council does not have to provide information which is already publicly available;

However, EIR have few exceptions (reasons why we do not have to disclose).

How to make an EIR request

If you know which department holds the information you require, please write to them directly.
 
Any information we supply to you under EIR is for your personal use.
Remember that the Council retains its copyright in all information it discloses.
If you wish to re-use (publish it, for example) some or all of the information
supplied to you and circulate it to a wider audience,it would be a great help
if you could tell us this, along with what you want the information for when
you first make your request.  
 
This will help us to make sure you get exactly what you want. It will also
allow us to consider what needs to be done regarding any permission
you may need to get.
 
We also publish guidance on this site on how we and our network
of departmental request coordinators will handle your requests for information,
this details all our procedures and processes followed. If you have any questions,

Remember also that you must obtain the Council's written
permission to reuse it's information and a charge for such re-use may apply.
