Schedule 2: Freedoms & Flexibilitites
The Government intends to make the changes specified below in various statutory and administrative requirements, as they relate to Leicester City Council. If the precise changes specified prove infeasible, the Government will use its best endeavours to achieve substantially the same effects by other means.
It is noted that some of the changes are dependent on the outcome of consultation and/or can be brought about only with Parliamentary approval.
The legal and practical feasibility of some of these changes had not been established at the time that this agreement was concluded.
In respect of Target 1 [To increase the percentage of pupils obtaining 5 or more GCSEs at grades A* - C]
Change 1
Within each of the Standards Fund categories listed below, DfES will permit the Council to use the amounts falling within those elements of the Standards Fund defined as being amounts retained by the Local Education Authority as a single total which could be applied without restriction to any of the purposes relevant to those sections of the Standards Fund; and, subject to the agreement of the Secretary of State for Education and Skills, to permit the Council to apply amounts retained by the Local Education Authority to any of the purposes relevant to sections of the Standards Fund outside the Standards Fund category for which the amount was originally allocated.
For the purposes of this change, the relevant Standards Fund categories are School Improvement; Inclusion; Standards and Curriculum; Diversity and Excellence; and Teachers and Support.
Assurance given by the Secretary of State for Education and Skills.
Other conditions placed on the authority, in relation to the acceptance of individual grants within these categories will not be affected by this change.
Change 2
The Council is given assurance by DfES of a minimum resource allocation through the Standard Fund of 95% of the 2001/ 2002 allocation for the duration of the period covered by this Local Public Service Agreement.
Change 3
DfES will consider priority roll out of any revised planning system to Leicester City Council dependant upon the criteria for any potential new system being met.
Change 4
DfES and Leicester City Council will meet by the end of July 2002 to discuss the issue of funding reflecting the additional costs more rapidly of influxes of pupils such as the Dutch Somalis in Leicester.
Change 5
DfES and Leicester City Council will continue the dialogue regarding the issue of funding reflecting the additional costs more rapidly of influxes of pupils, such as the Dutch Somalis in Leicester, until the introduction of the new Revenue Grant System in 2003/04.
In respect of Target 4 [Provide high quality pre-admission and rehabilitation care to older people to help them live as independently as possible] and

Department of Health agrees that it will invite Leicester City Council to participate in its information sharing group, as part of the Department’s information for social care programme of work. This will provide an opportunity for the Council to contribute at a national level to developing approaches that will improve information sharing between health and social care and support the improvement of the Council’s own approaches locally.
In respect of Target 9 [To improve the cleanliness of the City Centre]

DEFRA establish arrangements which allow for receipts arising from Fixed Penalty Notices for littering (Environmental Protection Act 1990 Part IV Section 88) surrendered by Leicester City Council to the Secretary of State, to be repaid to the authority for use in relation to approved categories of initiatives to further improve street cleanliness in Leicester.

The ODPM (Planning) agrees to extend to Leicester City Council the extra powers to combat fly-posting which London Borough Councils already enjoy by virtue of the amendments to section 225 made by the London Local Authorities Act 1995.
Unsupported Credit Approvals

The Office of the Deputy Prime Minister will permit Leicester City Council scope for an additional £2.5m of borrowing during the period of this local PSA. This borrowing will be unsupported by any additional grant or subsidy.
The ODPM will therefore issue an “Unsupported Credit Approval” (UCA) (a Supplementary Credit Approval that attracts no additional revenue support) of £2.5m to Leicester City Council. This UCA will be usable at any time during the Local PSA in respect of any of the projects listed below, subject to the maximum amount mentioned against each project.
