Rights of Way
What are Rights of Way?
A Right of Way is a path that anyone has the legal right to use on foot, and sometimes using other modes of transport. The Council has a duty to protect and maintain these paths and to record them on a Definitive Map.
Legally, a Right of Way is part of the highway network and subject to the same protection in law as all other highways. The following types of Rights of Way exist within Leicester:
- Footpaths are open only to walkers.
- Bridleways are also open to horse riders and cyclists.
There are also numerous other paths open to the public.
These include:
- Permissive paths where the owner has given permission to the public to use the path. The permission can be withdrawn at any time.
- Towpaths along canals. These are sometimes Rights of Way, and those that aren’t are usually open by permission.
- Cycletracks also available to walkers and horse riders.
The Vision for our Rights of Way Network by November 2017, all the City’s Public Rights of Way will be:
- Clearly waymarked throughout their lengths.
- Free of obstructions to fully-ambulant users.
- Free of unnecessary obstructions to people with disabilities.
- Contributing fully to our Local Transport Plan objectives.
- Protected against illegal obstructions, and managed in accordance with then-current legislation and best practices.

What is a RoWIP?
The Countryside and Rights of Way (CROW) Act 2000 placed a duty on the City Council to produce a Rights of Way Improvement Plan (ROWIP) which will set out a 10 year plan for improving the Rights of Way network. The plan should assess:
- the extent that Rights of Way meet the present and future needs of the public
- the opportunities provided by Rights of Way for exercise and other forms of open-air recreation
- the accessibility of Rights of Way to blind or partially sighted people and others with mobility problems
- any matters that the Secretary of State may direct.
It also contains a Statement of Action that the authority proposes to take for the management of Rights of Way, and for securing an improved network. The Plan is an integral part of the Local Transport Plan for Leicester, which sets out our intentions for how our network of Rights of Way will contribute to our wider transport strategies of improving accessibility (primarily to employment and education facilities) and providing leisure opportunities.

The summary includes a questionnaire that lets you tell us your views on our Draft Improvement Plan as well as letting us know why, how often and what you think of the existing experience of using Rights of Way in the city.
