Licensed Premises Gaming Machine Permit

Holders of Section 34 Permits (Pubs and Licensed Premises)

A Section 34 permit issued under the old legislation will remain valid under the new legislation, until its expiry date, as if it were a licensed premises gaming machine permit issued under the new Act.

 

Premises with up to two gaming machines

Pubs and some other licensed premises have an automatic entitlement to two gaming machines, subject to a simple notification procedure. Prior to your Section 34 permit expiring, you should write to Leicester City Council notifying us of your intention to make one or two Category C or D gaming machines available on the premises, in accordance with the automatic entitlement.

 

There is a fee for this procedure, which must be enclosed with the notification. Once notification has been made, the automatic entitlement is of unlimited duration.

 

Premises with more than two gaming machines

Pubs and other licensed premises that want to offer more than two gaming machines need to apply to Leicester City Council for a licensed premises gaming machine permit. You must apply before the date on which your current Section 34 permit is due to expire.

 

If you want to apply for more gaming machines than you are currently licensed for, you need to apply for a licensed premises gaming machine permit under the Gambling Act 2005. The licensing section is required to issue you with a permit under the new Act authorising the number of machines you are currently entitled to and then consider your application for more machines on its merit.

 

There is a fee for a licensed premises gaming machine permit, which must be enclosed with the application. Once granted, the permit is of unlimited duration but holders of this permit will have to pay an annual fee to Leicester City Council.

 

New Operators

If you wish to apply for a new licensed premises gaming machine permit, you must make your notification/application to Leicester City Council for the appropriate permission under the new Act.

It is important to note that this section relates to premises with a Licensing Act 2003 on-premises alcohol licence, that serve alcohol without the requirement that it accompanies food.

 

Pubs, restaurants or hotels will be able to notify/apply for a permit - but only if they have a bar. Hotels and restaurants that serve alcohol only with food, will not be able to provide gaming machines on the premises.
