We regard your privacy as important and comply with all the requirements of the
Data Protection Act 1998. All employees who have access to your personal data or are associated with the handling of that data are obliged to comply with the Data Protection Act.
How to request a copy of your personal information
Under the Data Protection Act (DPA), you have the right to apply for a copy of the personal information the Council holds about you.
This is known as a subject access request.
Here's how to do it:

Download and complete a request form. Make sure you include sufficient information for us to locate the data.

Return the request form to data.protection@leicester.gov.uk or use contact details below.

Pay the £10 subject access request fee.

- You can post a cheque or postal order to the address below.
- Cheques should be payable to 'Leicester City Council'.
- Alternatively you can pay in cash at any Customer Service Centre.
- You can appoint someone to apply on your behalf e.g. your legal guardian or a solicitor. They must usually have written authorisation from you.
- Any information you supply will be processed under the requirements of the Data Protection Act 1998 and only used for processing your request.
What happens after I request access to my information?
The Council is not obliged to comply with a subject access request on the basis of "What does the Council hold on computer about me?" It is also not obliged to comply with verbal requests for information.
The Council will ask you questions to identify what information you require and what your working and business connections are with it to help locate where the data may be held.
Information that may be exempt from disclosure to the data subject could include:
- Personal data where disclosure could prejudice the prevention or detection of crime
- Management forecasts/management planning
- Legal professional privilege (advice we receive from our solicitors, for example)
- Personal data identifying another person (a third party) whose details should not be disclosed without their permission
You are entitled to be told whether the Council, or someone acting on its behalf, is processing (using) your personal data and if so be given a description of:
- The personal data involved
- The purpose (s) for which it is being processed
- To whom the data are or may be disclosed
- The source of the information (exemptions may apply)
- The logic behind processing (except in the case of trade secrets)
If no data is held, or the data falls into a category exempted from disclosure, you should be notified in writing of this.
In all cases the Council is then required to respond within a statutory maximum limit of 40 calendar days of receiving your full request, either with the information required, or with an explanation of any delays.
Information about other people
Please note also that Leicester City Council will not discuss other people's (third party) details, such as their accounts or applications with you without the express written and signed authorisation of that person when they are not present.
To discuss someone else's details with you, we will need this or a valid legal document to be presented (e.g. Power of Attorney).
We do this for the protection of all our customers' personal information as governed by the Data Protection Act 1988.
Sometimes, if the law allows us to, we can or have to, release information about you however. Solicitors may request information under s35 of the Data Protection Act, or The Police may under s29. We currently do not charge for s29 requests. We may charge for s35 requests just to cover our costs e.g. providing CCTV footage.
