To make a minor (non-material) change to a planning permission now requires a formal application. This procedure came into effect on 1 October 2009, by means of Section 96A to the 1990 Town & Country Planning Act.
Following a grant of planning permission, it is sometimes necessary to make small amendments, for example moving a door or window. Whether or not such amendments are non-material will depend on the circumstances of each case. For instance, moving a window could be material if it results in the overlooking of a neighbour, but could be non-material if it does not. It is hoped that this formal process will remove the need for entirely new applications where only a very small change is sought.
A new full application is normally required for material (significant) amendments to an earlier planning permission. There are limited circumstances where changes like this can be done by applying to vary conditions. Contact Planning for further information and advice.
