Contaminated Land and Planning

Advice for Developers

The Council will not normally grant planning permission for development on contaminated land, unless the risks caused by the contamination can be overcome; this may involve legal agreements or conditions being applied to the permission. Developers are encouraged to discuss with our Planning service at an early stage.

A Developers Guide, giving advice to property owners, developers, architects and surveyors when applying to develop, or significantly change the use of a piece of land which may be contaminated, has been developed by the Leicestershire Pollution group.

National planning policies relating to contaminated land are contained in the Government's Planning Policy Statement 23: Planning and Pollution Control.

Pollution Control

The Council's Pollution Control group has the duty to ensure that contaminated land is identified, investigated and remedied. A Contaminated Land Strategy has been produced.
