When under occupancy rules don't apply

Sometimes the under occupancy rules will not be applied, such as in the case of a death in the family and some other circumstances.

If a member of your household dies – and this would usually mean that you are classed as under occupying – the rules will not be applied for 12 months. This gives you time to decide whether to move or not. After 12 months the under occupancy rules will be applied and you will have to make up any shortfall in rent.

If you are placed in temporary bed and breakfast accommodation, or a council hostel because you are homeless or to prevent homelessness the rules don't apply.

If you live in accommodation where you are receiving care, support or supervision the rules will not apply.
