Environmental Information Regulations

The Environmental Information Regulations 2004 (EIR) provide you with a right of access to a wide range of environmental information held by the Council. They came into full effect from January 2005.

What is environmental information?


  • Any information relating to the state of the elements: including land, water, air, flora or fauna.
  • Any information about activities which adversely affect the environment (including noise and other nuisances).
  • Any information about measures which are designed to protect the environment.
  • This also includes plans, programmes, cost-benefit and other economic analyses which relate to environmental information.
  • Other information held by the Council such as information relating to road, traffic, maintenance, land use planning, development control, buildings and estates is also considered to be environmental information.


How to make an EIR request

What to expect when making an EIR request


  • You will be able to say in what format you wish to receive the information.
  • The timescale for responses is one month (in practice 20 working days).
  • The Council can charge a fee reason for supplying information under EIR.
  • We not have to provide information which is already publicly available.
  • There are some cases when we do not have to disclose information under the EIR, we will tell you if this is the case with your request. 


EIR re-use and copyright

 

  • Any information we supply to you under EIR should be for your personal use.
  • We retain copyright to all information we disclose.
  • It would be helpful if you could tell us if you plan to re-use or publish the information we give you when you first make your request.
  • It would also be helpful if you could tell us your reason for requesting the information when you first make your request.
  • This will help us to make sure you get exactly what you want. It will also help us to consider what needs to be done regarding any permission you may need to obtain.


Remember: you must obtain the Council's written permission to reuse its information and a charge for such re-use may apply.
