Why do I need Building Regulation Approval ?

 

In most cases there is a legal requirement (under The Building Act 1984) to get approval under The Building Regulations if you are extending, altering or erecting a building.

 

This is to safe guard you, the general public, and any subsequent owners of the building.

 

Most extensions (with the exception of some porches, conservatories or covered ways) require Building Regulation approval, though in some cases you may not require Planning Permission.

It is always advisable to check with both sections, or look at the Planning Portal website for information.

 

All structural alterations will require approval under Building Regulations, and some other alterations such as reroofing, rendering, replacement windows and domestic electrical work will probably also require approval.

What is Building Control ?

 

Building Control is the section of the City Council that deals with Building Regulations,  dangerous structures and demolitions.

Leicester City Building Control is part of the Local Authority Building Control organisation (LABC) which covers Building Regulations nationally.

What is the difference between Planning Permission and Building Regulation Approval ?

 

Planning and Building Control are separate disciplines dealing with different subjects, though sometimes they do overlap.

Building  Regulations deal with safety, health and welfare of the public, and thermal efficiency of buildings. That is making sure the building is structurally safe; that there is low fire risk to occupants and other buildings; ensuring adequate ventilation, access and facilities  are provided for all (including disabled persons); and checking that the building is adequately insulated etc.

 

Planning deal with environmental issues: how the building looks, how it affects the existing property and how it affects the neighbours,  and that there is correct use of the land.

Why do I have to pay for the service ?

 

You only pay for our service when you use it. The building regulation section is not funded out of your Council tax. The plan and inspection fees cover our costs to provide the service.

Can you recommend a builder ?

 

We have to remain independent and therefore cannot recommend individual builders or firms. Therefore we do not have a list of approved contractors. Some further information on choosing a builder is available to download from our Guidance Notes page.
