Introduction to Scheduled Monuments
Under the provisions of the Ancient Monuments and Archaeological Areas Act 1979, the Secretary of State is responsible for compiling and maintaining a schedule of ancient monuments which are of national importance and which warrant statutory protection. Only a very small minority of archaeological monuments are afforded this level of protection, but those that are are referred to as Scheduled Monuments.
A Scheduled Monument is a building, structure or any other work above or below ground (other than dwelling houses or buildings in use for ecclesiastical purposes) which is included on the Secretary of State’s schedule.
Scheduled Monument Consent
It is an offence to carry out any works or operations (including works such as repair or cleaning) in any way affecting or altering a scheduled monument without first applying for and obtaining Scheduled Monument Consent from the Secretary of State. This is separate from any requirement for planning permission. Where a structure also appears on the list of buildings of Special Architectural or Historic Interest, the ancient monuments legislation takes precedence.
